These Terms and Conditions ("Terms") govern your access to and use of thepropact.com (the "Site") and any purchase you make from us. By browsing the Site, creating an account, applying for PACT PRO membership, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
We may update these Terms from time to time to reflect changes in our business or the law. The version in force at the time you place an order, or use a particular feature of the Site, is the one that applies. The current version is always posted on this page with an updated "Last updated" date.
Pact Pro Ltd ("PACT", "we", "us", "our"), trading as PACT, is a company registered in England & Wales under company number 17292646, with its registered office at 161 Bexhill Road, St. Leonards-on-Sea, TN38 8BG, United Kingdom.
You can contact us at hello@thepropact.com. For PACT PRO membership queries, use pro@thepropact.com.
The Site is intended for personal, non‑commercial use by individuals aged 18 or over. By using the Site or placing an order, you confirm that you are at least 18 and able to form a legally binding contract.
We provide the Site "as is" and do not guarantee that it will always be available, uninterrupted, or error‑free. We may suspend, restrict, or withdraw all or part of the Site at any time, including for maintenance, without liability to you, provided this does not affect orders you have already placed.
If you create an account, you're responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.
PACT sells refillable makeup palettes constructed from aluminium, iron, and chemically strengthened glass. Product images, colourways, and pan configurations on the Site are for illustration and may vary slightly from the item you receive due to manufacturing tolerances, screen display, and ongoing product development.
We describe our warranty and material claims (including any stated durability or compliance claims) to the best of our knowledge at the time of publishing. We reserve the right to amend specifications, pan layouts, and finishes for future production runs without notice, provided this does not affect orders already placed.
From time to time we may run promotions, offer discount codes, or provide free gifts with purchase. Unless stated otherwise, each promotion: is limited to one use per customer/order; cannot be combined with any other offer, including PACT PRO discounts; has no cash value or cash alternative; and may be withdrawn, amended, or ended at any time without notice, provided this does not affect orders already placed using the code.
We may refuse or cancel an order where we reasonably believe a promotional code has been obtained fraudulently, shared publicly outside its intended audience, or used in a way that breaches these Terms.
When you place an order, you are making an offer to buy. We accept your order — and a contract is formed — only when we send you a dispatch confirmation email, not when we send an order confirmation or take payment. We may decline or cancel an order before dispatch (for example, out‑of‑stock items, pricing errors, or suspected fraud), in which case we will refund any payment taken in full.
You must provide accurate and complete information when ordering, including a valid delivery address and contact details.
All prices on the Site are shown in GBP (£) and, where applicable, include UK VAT at the prevailing rate. For deliveries outside the UK, additional import duties, taxes, or customs charges may apply and are the responsibility of the recipient, unless otherwise stated at checkout.
Payment is taken via our third‑party payment processor at the time of order. We do not store your full card details. If we discover a pricing or description error after you have ordered, we will contact you before dispatch to confirm whether you wish to proceed at the correct price or cancel for a full refund.
We currently ship to addresses in the United Kingdom and the European Union. Delivery times shown at checkout are estimates, not guarantees, and may be affected by courier delays, customs processing, or events outside our control (see Section 18).
Risk in the goods (loss or damage) passes to you on delivery. Ownership of the goods passes to you once we have received payment in full.
If you are a consumer ordering from the UK or the EU, you have a legal right to cancel your order within 14 days of receiving your goods, without giving a reason, under the UK Consumer Contracts Regulations 2013 and the equivalent EU Consumer Rights Directive. To cancel, contact us at hello@thepropact.com before the 14‑day period ends.
You must then return the goods to us within 14 days of telling us you wish to cancel, in the condition you received them (unused, with original packaging where possible). You are responsible for the cost of returning the item unless it arrived faulty or not as described. We will refund your payment, including standard delivery charges, within 14 days of receiving the returned item or evidence you have sent it back — whichever is earlier.
This cancellation right does not apply to items that have been used, personalised, or where hygiene/refill inserts have been removed from sealed packaging, to the extent permitted by law.
Separately from your cancellation right above, if a product is faulty, damaged on arrival, or not as described, you have statutory rights under the UK Consumer Rights Act 2015 (or the equivalent consumer protection law in your EU country of residence) to a repair, replacement, or refund. Nothing in these Terms limits those statutory rights.
In addition, PACT frames carry a 1‑year warranty against manufacturing defects in materials and workmanship from the date of delivery. This warranty does not cover normal wear and tear, damage from misuse, drops, or unauthorised modification, and does not extend to consumable refill pans, which are expected to be replaced through normal use.
To make a warranty or faulty‑goods claim, email hello@thepropact.com with your order number and a description (and photo, where relevant) of the fault. We will confirm next steps, including whether we need the item returned, within a reasonable time.
PACT PRO is a free membership programme for working makeup artists and professionals ("Members"). These additional terms apply if you apply for or hold PACT PRO membership, alongside the rest of these Terms.
Membership is open to applicants who confirm they are working makeup artists and provide supporting information (such as a job title, portfolio/Instagram handle, primary discipline, and a supporting document like a callsheet or work sample) as part of the application. We may accept, reject, or request further information for any application at our discretion, and may periodically re‑verify a Member's status.
Membership is free and does not involve a subscription, recurring payment, or renewal date. The first cohort of verified Members ("founding members") receive 15% off their first order and 10% off subsequent orders; Members verified after the founding cohort closes receive 10% off. Discount codes are personal to the Member, may not be transferred, sold, or shared, are limited to one use per order, and cannot be combined with other promotional offers unless we state otherwise.
We may suspend or revoke a Member's PACT PRO status, at our reasonable discretion, if we believe the eligibility criteria are no longer met, the account is being misused (including code sharing or fraudulent verification), or the applicant provided false information. We may also modify, pause, or discontinue the PACT PRO programme at any time; this will not affect discounts already applied to orders placed before the change.
Personal data collected as part of a PACT PRO application, including supporting documents, is handled in accordance with our Privacy Policy.
If we allow you to submit reviews, photos, or other content about our products, you confirm that the content is your own honest opinion and experience, does not infringe anyone else's rights, and is not offensive, defamatory, or misleading. By submitting content, you grant us a non‑exclusive, royalty‑free licence to use, reproduce, and display it in connection with promoting PACT, on the Site and elsewhere, unless you tell us otherwise and we agree.
We may remove or decline to publish any content at our discretion, including where we believe it breaches these Terms or the law.
All content on the Site — including the PACT name, logo, product designs, photography, and text — is owned by or licensed to Pact Pro Ltd and is protected by copyright, trade mark, and other intellectual property laws. You may not copy, reproduce, or use this content for commercial purposes without our written permission.
The Site may contain links to third‑party websites (for example, social media or payment providers). We don't control these sites and aren't responsible for their content, policies, or practices. Visiting a linked site is at your own risk and subject to that site's own terms.
You agree not to misuse the Site, including by attempting unauthorised access, submitting false information (including in a PACT PRO application or a review), introducing viruses or harmful code, or using the Site in a way that could damage, disable, or impair it or interfere with anyone else's use of it.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK or EU law.
Subject to the above, we are not liable for any indirect or consequential loss, or for business losses (including loss of profit, business, or opportunity), arising from your use of the Site or purchase of our products. This does not affect your statutory rights as a consumer.
You agree to reimburse us for any reasonable losses, damages, or costs (including legal fees) we incur as a result of your breach of these Terms or your misuse of the Site, except to the extent caused by our own negligence or breach.
We are not responsible for any delay or failure to perform our obligations under these Terms caused by events outside our reasonable control, including strikes, customs delays, courier disruption, extreme weather, or supply chain failures affecting our manufacturing partners.
If you have a complaint, please contact us first at hello@thepropact.com so we can try to resolve it directly. UK consumers can also use the Citizens Advice consumer service, and EU consumers can use the European Commission's Online Dispute Resolution platform to raise a complaint.
These Terms are governed by the law of England and Wales. If you are a consumer resident in the EU, you also benefit from any mandatory consumer protection provisions of the law of your country of residence, and may bring proceedings in the courts of your own country as well as in England and Wales.
If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce a right under these Terms is not a waiver of that right. We may transfer our rights and obligations under these Terms to another organisation; this will not affect your rights. These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding the Site and your orders.
